The proposed rule through which CISA intends to implement CIRCIA would create a new 6 CFR Part 226. Covered entities are organisations in a critical infrastructure sector that exceed the Small Business Administration's small business size standard or meet sector-based criteria (for example chemical facilities, communications providers, hospitals, IT providers to the federal government, nuclear plants, transportation, and water systems serving more than 3,300 people). They would have to report covered cyber incidents to CISA within 72 hours of reasonably believing they occurred and ransom payments within 24 hours of disbursement, submit supplemental reports promptly, and preserve incident data for at least two years. Where reports are not made, CISA could issue requests for information and subpoenas and refer cases to the Department of Justice. CISA estimates about 316,000 covered entities and a cost of 2.6 billion dollars over the analysis period.
