Summary
The executive order seeks to promote advanced artificial intelligence innovation and security by modernising public and private information systems and hardening them against external threats, in collaboration with the private sector and without new regulatory burdens on developers. Within 30 days the Committee on National Security Systems and the Department of War must prioritise the cyber defence of their systems; CISA must issue Binding Operational Directives and other guidance to protect federal civilian systems, expand AI-enabled defensive tools and facilitate access to them for state and local authorities and critical infrastructure operators such as rural hospitals, community banks and local utilities. The Treasury, with the NSA and CISA, must form a voluntary AI cybersecurity clearinghouse with the AI industry and critical infrastructure operators to scan for, validate and remediate software vulnerabilities. Within 60 days agencies must develop a classified benchmarking process for the advanced cyber capabilities of AI models, setting the threshold at which a model becomes a covered frontier model, and a voluntary framework through which developers can give the government access to such models up to 30 days before release to other trusted partners, while ruling out any mandatory licensing or preclearance. The Attorney General must prioritise prosecuting anyone who uses AI, including AI agents, to access computer systems or data unlawfully.
Who it applies to
Federal agencies, in particular the Committee on National Security Systems, the Department of War and the NSA, CISA, the Treasury, OMB, OPM and the Department of Justice; participation is voluntary for AI developers and critical infrastructure operators.
Key dates
- Deadline to prioritise the cyber defence of national security systems and Department of War systems, for CISA's Binding Operational Directives on federal civilian systems and for setting up the Treasury-led AI cybersecurity clearinghouse on software vulnerabilities
- Deadline for the classified benchmarking process for the cyber capabilities of AI models, with the covered frontier model threshold, for the voluntary framework with developers and for expanding the hiring of cybersecurity specialists in the US Tech Force
