Law 2018-026 on cybersecurity and cybercrime

Summary

The Law sets Togo's cybersecurity framework and the criminal-law protection of the information society. It entrusts the Government, through the ministries for security and the digital economy, with defining national cybersecurity policy and the strategies that implement it, and makes the security ministry the government authority for cybersecurity. It establishes the National Cybersecurity Agency (ANCy), the national authority for the security of essential infrastructure and public authorities' information systems, which designates operators of essential services, sets their protection rules, checks compliance, grants accreditations and may impose sanctions. It creates a Digital Sovereignty Fund. The second part defines computer offences (illegal access, interference with systems and data, child sexual abuse material, racist or xenophobic content, online threats and insults) and their penalties.
