Law 5/2022 on Combating Cybercrime

Summary

Law of the Libyan House of Representatives, issued in Tobruk on 27 September 2022, aimed at protecting electronic transactions and reducing cybercrime by defining offences and penalties. In 53 articles it punishes, among other things, unlawful access to systems and networks, interception, the supply of tools to bypass protection, damage to information systems, digital identity theft, payment card forgery, pornography and the exploitation of minors, online harassment and copyright infringement. It empowers the National Information Security and Safety Authority (NISSA) to monitor content published online and to block content deemed to threaten security and social peace, while monitoring messages and conversations requires a court order. Producing, holding or distributing encryption tools requires a NISSA licence.
