The Act brings into Liechtenstein law the NIS 2 Directive (EU) 2022/2555, which applies as national law until it is incorporated into the EEA Agreement, and replaces the Cyber Security Act of 2023. It covers medium-sized and large companies and public bodies in the sectors listed in its annexes and, regardless of size, electronic communications providers, trust service providers, domain registries and DNS providers. Essential and important entities must take risk management measures, register with the Stabsstelle Cyber-Sicherheit and report significant incidents with an early warning within 24 hours, a notification within 72 hours and a final report within one month. The Stabsstelle Cyber-Sicherheit is the competent authority, single point of contact, cyber crisis authority and certification authority. Fines can reach CHF 10 million or 2% of worldwide turnover for essential entities and CHF 7 million or 1.4% for important entities.

Who it applies to

Medium-sized and large public and private entities in the sectors of Annexes 1 and 2 operating in Liechtenstein; regardless of size, electronic communications providers, trust service providers, TLD registries, DNS providers and other entities named in the Act.
