Cybercrime Act 2018 (Act No. 16 of 2018)

Summary

The Act creates cybercrime offences in Guyana: illegal access, interception and interference with data and systems, illegal devices, computer-related forgery and fraud, offences affecting critical infrastructure, identity-related offences, child pornography and child luring, publication of intimate images, spam and fraudulent websites, online harassment and offences against the State. It governs investigations through retention of traffic data by service providers, search and seizure, production and expedited preservation orders, removal of data, remote forensic tools and forfeiture.

Passed by the National Assembly on 20 July 2018 and published in the Official Gazette of 13 August 2018. In 2022 the Government announced amendments to section 18 on offences against the State.
