Summary

The Act converts and replaces the 2025 Cyber Security Ordinance, which had repealed the controversial Cyber Security Act 2023, and is deemed to have been in force since 21 May 2025. It establishes the National Cyber Security Agency, headed by a Director General, and a National Cyber Security Council, and provides for computer emergency response teams (CERTs) and digital forensic labs. The government declares critical information infrastructure by notification and updates the list every year; such infrastructure must carry out a yearly audit and is subject to monitoring and inspection. The Director General can remove or have blocked content that threatens cyber security and, at the request of law enforcement, content that undermines security or public order or incites violence through religious or ethnic hatred, but tribunal approval is required within three days, failing which the content must be restored. The Act punishes illegal access and hacking, especially against critical infrastructure, online fraud and cheating, cyber terrorism, online sexual harassment and blackmail and content inciting religious or ethnic hatred, and governs investigations, trials and international cooperation.

Who it applies to

Anyone committing the offences it defines in Bangladesh or, under certain conditions, from abroad, operators of critical information infrastructure declared by the government and the authorities responsible for cyber security and investigations.
