Brunei Cybersecurity Act (Chapter 272, formerly Cybersecurity Order 2023) Enacted as the Cybersecurity Order 2023 and republished in the 2024 revised edition as the Cybersecurity Act (Chapter 272), this is Brunei's framework law on cybersecurity. It establishes the Commissioner of Cybersecurity, appointed by the Minister with the consent of the Sultan, who administers the Act, designates critical information infrastructure, issues codes of practice and standards of performance and may give binding written directions. Owners of critical information infrastructure must report prescribed cybersecurity incidents within the prescribed period, have a compliance audit carried out at least every two years, conduct a yearly risk assessment and take part in cybersecurity exercises. The Act also grants powers to investigate and respond to cybersecurity threats and incidents, including serious ones, and to order emergency measures; failure to report is punishable by a fine of up to 100,000 Brunei dollars, up to two years' imprisonment, or both.
